Dental Queue – Terms & Conditions

These Terms & Conditions apply when you purchase services from Dental Queue. Please read them carefully before placing an order.
1. About us
Dental Queue is a trading name of HomeSave Services Ltd, a company registered in England and Wales.

In these terms, “Dental Queue”, “we”, “us” and “our” refer to HomeSave Services Ltd trading as Dental Queue.
2. Our service
Dental Queue provides a service designed to help customers find dental practices that may provide NHS dental services and to contact suitable practices on the customer's behalf.
Depending on the service purchased, we may search for suitable dental practices, contact practices to enquire about NHS availability or waiting lists, provide information supplied by the customer where reasonably necessary, and request that the customer or other patients included in the order are added to a waiting list or considered for NHS treatment where the practice permits this.
The exact service included in your purchase will be as described on our website and checkout page at the time you place your order.
Dental Queue is an independent service. We are not part of, affiliated with, endorsed by or acting on behalf of the NHS, any dental practice or any other healthcare provider.
3. No guarantee of finding an NHS dentist
You are paying Dental Queue to perform the service described at the time of purchase. You are not paying for a guaranteed NHS dental place, appointment or registration.
We cannot guarantee that:

any dental practice is currently accepting new NHS patients;

a practice operates a waiting list;
-
a practice will allow us to add you to its waiting list;
-
a practice will accept you as an NHS patient;
-
being placed on a waiting list will result in an appointment;
-
an NHS place will become available within any particular period; or
-
a practice's availability or policies will remain unchanged.
Dental practices independently determine whether they accept NHS patients, operate waiting lists and ultimately offer treatment.
A lack of NHS availability does not, by itself, mean that Dental Queue has failed to provide the service you purchased.
4. Contacting dental practices on your behalf
By purchasing the service and providing us with the relevant patient's information, you authorise Dental Queue to contact dental practices on the patient's behalf for the purpose of carrying out the service.
This may include providing dental practices with information reasonably required to identify the patient, enquire about availability or request placement on a waiting list.
We will not knowingly claim to be the patient. We may explain that we are contacting the practice on the patient's behalf.
Some dental practices may require the patient to contact them directly, complete their own form, verify their identity or provide additional information. Where appropriate, we may tell you what further action is required.
5. Information you provide
You are responsible for ensuring that information you provide to us is accurate and reasonably up to date.
If you provide information about another person, including a partner or child, you confirm that you are authorised to provide that information and to ask us to use it for the purposes of providing the service.
If inaccurate, incomplete or missing information prevents us from carrying out some or all of the service, we may contact you for further information or be unable to complete the affected part of the service.
6. Information from dental practices
Information about NHS availability, waiting lists, estimated waiting times and practice policies may be provided to us by dental practices or obtained from publicly available sources.
This information can change quickly and is outside our control. We therefore cannot guarantee that information supplied by a dental practice remains accurate after it is provided to us.
7. Starting the service
Unless stated otherwise when you order, we aim to begin providing the service as soon as reasonably practicable after your order is placed and the necessary information has been received.
Where you expressly request that we begin providing the service during your statutory 14-day cancellation period, you authorise us to begin work before that period expires.
8. Cancellation rights
If you are a consumer purchasing our service online, you will normally have a legal right to cancel your contract within 14 days of entering into it.
If you expressly request that we begin providing the service during this 14-day period and you subsequently cancel before the service has been fully performed, you may be required to pay an amount proportionate to the services already supplied up to the point at which you tell us that you wish to cancel.
If the service has been fully performed within the cancellation period following your express request for it to begin, and you have acknowledged that you will lose your cancellation right once the service has been fully performed, your statutory right to cancel will end when the service has been fully performed.
To exercise a cancellation right, contact us at hello@dentalqueueco.uk with a clear statement that you wish to cancel.
Nothing in these terms affects any statutory rights that cannot legally be excluded or restricted.
9. Completion of the service
Our service will normally be considered completed when we have carried out the searches, enquiries, contact attempts and/or waiting-list requests included in the service you purchased and have provided you with the relevant outcome or results.
Completion does not depend on successfully securing an NHS dental place, appointment or waiting-list position unless the particular service you purchased expressly states otherwise.
Where a dental practice requires you to take further action yourself, our service in relation to that practice may be complete once we have informed you of the action required.
10. Timescales
Any timescale stated on our website is an estimate unless we expressly state that it is guaranteed.
Our ability to complete the service may depend on dental practices answering telephone calls, responding to enquiries or providing information. These matters are outside our control.
11. After we have contacted a practice
If a dental practice adds you to a waiting list, offers you an appointment or asks you to contact it directly, it is your responsibility to respond to the practice and comply with any requirements it imposes.
Dental Queue is not responsible for appointments, waiting-list positions or opportunities subsequently lost because a patient does not respond to a dental practice, provides incorrect information, fails to attend an appointment or does not complete a required action.
12. Refunds and problems with the service
Because the service involves carrying out searches and contacting third-party dental practices rather than guaranteeing a particular outcome, you are not automatically entitled to a refund simply because no suitable NHS availability or waiting-list position is found.
However, this does not affect your statutory consumer rights. If we fail to provide the service you purchased with reasonable care and skill or otherwise fail to provide it as required by law, you may have legal remedies.

13. Dental and medical advice
Dental Queue is an administrative search and contacting service. We do not provide dental or medical advice, diagnosis or treatment.
Our service should not be used as a substitute for professional medical or dental advice and is not intended for dental or medical emergencies.
If you require urgent dental or medical assistance, you should use the appropriate NHS or emergency services.
14. Price and payment
The price payable is the price displayed at checkout when you place your order.
Payment must be successfully completed before we are required to begin providing the service.
15. Personal information
We process personal information in order to provide our services and for other purposes described in our Privacy Policy.
By asking us to contact dental practices on behalf of a patient, you understand that we may need to disclose relevant patient information to those practices in order to perform the service.

16. Our responsibility to you
We are responsible for losses you suffer that are a foreseeable result of our breaching these terms or failing to use reasonable care and skill.
We are not responsible for the acts or omissions of independent dental practices, including decisions about NHS availability, waiting lists, appointments, treatment or patient acceptance.
We do not exclude or limit liability where it would be unlawful for us to do so, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
17. Events outside our reasonable control
We are not responsible for delays or failures caused by events outside our reasonable control, such as telecommunications failures, website or service outages, dental practice closures or circumstances preventing practices from responding to us.
Where possible, we will take reasonable steps to minimise the effect of such events.
18. Changes to these terms
We may update these Terms & Conditions from time to time.
The terms applicable to your purchase will normally be those in effect when you place your order. Any subsequent changes will not retrospectively alter your existing contract unless required by law or agreed with you.
19. If part of these terms is invalid
If any provision of these terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
20. Governing law
These terms are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you may also be entitled to the protection of mandatory laws applicable where you live and may have rights to bring proceedings in the courts applicable to your part of the United Kingdom.
